What is a trademark in Turkey?

In Turkey, a trademark includes any design, image, word, expression, seal, or cover used to distinguish industrial, commercial, or agricultural products. Moreover, trademarks serve as a form of intellectual property, protecting the brand identity of products or services. Since Turkey joined the Madrid Protocol in 2003, you can easily expand your trademark application internationally. Therefore, registering a trademark in Turkey grants you the exclusive right to use it and protects your brand against unauthorized use or copying by third parties.

  2. Submission of Application: After confirming the availability of your distinctive sign, you can submit your trademark application to the Turkish Patent and Trademark Office (TPTO). The office will then perform a preliminary review to identify any errors or missing information.
  3. Examination: The TPTO begins the examination by verifying that the application meets all formal requirements.
  4. Opposition: Following verification, the application is published, and during the opposition period—typically lasting a few months—third parties with legitimate interests may file oppositions. They can also provide additional evidence to support their objections.
  5. Formal Examination: Once the opposition period ends, the examiner assesses whether the application meets all criteria, including applicant details and proper classification of goods or services.
  6. Review and Trademark Certificate: Upon successful completion of the examination and opposition stages, the TPTO issues a Certificate of Trademark Registration. This certificate grants the trademark owner exclusive rights to use the registered trademark for the specified goods or services in Turkey.
