What is a trademark in Jordan?

In Jordan, trademarks include all signs that are distinctive and graphically representable. These may consist of words, names, acronyms, letters, numbers, devices, emblems, holograms, color combinations, or the three-dimensional shape of a product or its packaging. Additionally, sound marks, olfactory marks, and any combination of the above elements may qualify as trademarks.

However, single colors alone are generally not registrable unless combined with a unique design that adds distinctiveness.

  1. Conducting a Trademark Search:
Before submitting your application, you should check whether your chosen trademark is available. Some signs may not qualify for protection due to specific restrictions. 2. Submission of Application:
Once you confirm that your trademark is available, submit the application to the Jordanian Intellectual Property Office. The Office reviews it to ensure all required details and documents are complete.

  3. Initial Examination:
After submission, the Office examines the application to verify compliance with formal requirements. They check that the information provided, such as applicant details and classifications, is accurate and complete.

  4. Publication and Opposition Period:
If the application meets all formal criteria, it is published in an official gazette. This publication informs the public and opens a 60-working-day opposition period. During this time, third parties with valid claims may file oppositions and submit supporting evidence.

  5. Final Formal Examination:
Once the opposition period ends, the examiner performs a final review. This includes confirming the applicant’s name, nationality, address, and ensuring correct classification of goods or services.

  6. Application Review and Trademark Certificate:
Finally, if the application complies with all legal requirements and no successful opposition is filed, the Office approves the application. They then issue a Trademark Registration Certificate, granting exclusive rights to use the mark in Jordan for the listed goods or services.
