How to file a trademark in Chile?

To file a trademark in Chile can be done on-line, by post or personally; the form must must contain at least the following:

 

  1. Documents required:
    A. Complete name and address of the applicant(s);
    B. Particulars of a mark
    C. Class/es in which the trademark application is to be filed
    D. Photo file of the trademark, detailed and accurate labeling of the product or service to be trademarked. 
  2. Power of Attorney: signed by the applicant or an authorized officer of the applicant company.

How is the process of filing a Trademark in Chile?

Previous Search:
Before initiating the trademark application process, applicants must verify that their distinctive sign is available. Submission of Application:
Once you submit the trademark application in Chile, INAPI reviews the request. Registering a trademark grants you the exclusive right to use it in the market and prevents unauthorized use by third parties.

Preliminary Examination:
Next, INAPI examines the application for errors or missing information. If necessary, you may submit corrections or additional documents within a 30-day period.

Publication:
After INAPI approves the application and required documents, it publishes the application in the Official Gazette. The trademark appears in the Bulletin for 20 days, during which any third party may file an opposition.

Formal Examination:
If no opposition is filed within the publication period, INAPI issues a final resolution to approve the trademark.

Extra Information regarding Trademarks in Chile

Priority Document: 

The original priority document translated into Spanish must be submitted to the Chilean Trademark office within 90 days from the date filing.

Validity term:

The processing time from the first filing to registration is approximately 12 months in the case of a smooth registration procedure. The validity term of a trademark in Chile is 10 years from registration. Trademark registration renewal may be requested during the validity term or within 6 months after expiry.

Opposition and Appeal: 

During the publication stage it is possible to make objections the opposition period is 30 labor days from publication date of the application.
