What is a patent in Israel?

A patent in Israel grants the inventor exclusive rights to their invention for up to 20 years. This right allows the inventor to prevent others from making, using, selling, offering for sale, or importing the patented invention without authorization.

How to file a patent in Israel?

Israel requires patent applications to be filed in Hebrew. You can file in another language, but you must submit a sworn Hebrew translation within 10 working days (or 60 days for Arabic).

The patent process typically takes 3 to 5 years if no opposition occurs.

A patent application must include:

  • Applicant’s full name and address

  • Inventor’s full name and address

  • Invention title and abstract

  • Full description and claims (in English)

  • Formal drawings (in English)

  • Translations if extending a foreign application

  • Certified priority document within 30 days

  • Official search results from the original patent office

How is the Patent process in Israel?

Application Submission: To start the process, applicants must complete the application form either through the eSystem or in person at the Israel Patent Office. The office only considers the application officially submitted once the corresponding fee is paid.

Preliminary Examination: Next, the office reviews the application—usually within 30 working days—to ensure that all required information is complete and accurate. The abstract must clearly describe the invention.

Request for Completion (if needed): If any part of the application is incomplete, the Israel Patent Office will issue a request for correction. Applicants typically have two months to respond, with the option to extend this period by an additional two months.

Publication: After the preliminary review, the application enters the publication phase. At this point, the public can access the application’s content, and third parties have 60 days to submit observations. These comments are considered recommendations and help examiners assess the application. Applicants may request publication any time within the first 18 months after filing.

Examination: Finally, the applicant must pay the examination fee within six months of publication. Patent examiners will then conduct a thorough review, using national and international databases to determine whether the invention meets Israel’s patentability requirements.

The average time from filing to granting a patent in the United Arab Emirates is 5-6 years.

Grant, validity term and maintenance fees

Once Israel grants a patent, it remains valid for 20 years. The first and second annuities are paid together with the filing fees.

The first annual fee due is the third one, calculated from the international filing date. You must pay it before the second anniversary of that date.

Afterward, you pay subsequent annual fees every year on the anniversary of the international filing date.
