What is a patent in Iran?
The RPI grants inventors in Iran an exclusive patent right for their inventions. This right enables patent holders to prevent others from copying, using, distributing, or selling their invention without permission. The patent protects the invention for 20 years from the filing date.
How to file a patent in Iran?
In Iran, the official language for patent filing is Persian, and patent applications must be submitted in Persian. Filing a patent application in a foreign language is generally not possible.
Also, you may need to file a trademark in Iran.
What are the required documents needed to file a patent in Iran?
- Full name and address of the applicant and inventors, whether an individual or a corporation.
- A patent description: Specification, claims, and abstract. Drawings, if applicable.
- Power of Attorney, duly signed by the applicant.
- Translations (if necessary): In Iran, the official language for patent filing is Persian. If your application documents are in a language other than Persian, you may need to provide Persian translations of the application documents.
- Certified copy of the Priority Application. Not necessary for PCT cases.
How is the Patent process in Iran?

Application Submission: Submit the application form along with the complete documentation to start the patent process.

Formal Examination: The IPC formally examines the patent application to verify its completeness and compliance with all requirements.

Notification of Deficiencies: If IPC identifies any deficiencies, they notify you so you can correct them within a specified timeframe.

Publication: After passing the formal examination, IPC publishes the patent application in an official gazette or designated platform to notify the public.

Opposition Period: Third parties can submit observations or oppositions within 90 days of the publication.

Substantive Examination: IPC evaluates the patentability of the invention by assessing novelty, inventive step, and industrial applicability.

Grant of Patent: If the invention meets all patentability criteria and completes the examination process, IPC grants the patent and issues a patent registration certificate to you.
Patent term:
A patent in Iran lasts 20 years from the date you file the application.
Average time from filing to grant:
On average, it takes between 3 to 5 years from filing until the patent is granted.
Grant, validity term and maintenance fees
Once the patent in Iran is granted, it will be valid for 20 years. Maintenance Fees are paid annually and they are calculated from the international filing date.
The first annuity Fee should be paid on or before the 2nd Anniversary of the international PCT filing date (or national filing date if it is a Paris convention application). That is to say, it should be paid before starting the 3rd year.
Subsequent renewal fees should be paid annually in advance, before each anniversary of the filing date.
